Further updates on EPS-95 matter in today’s hearing in Supreme Court:
Mr.Aryama Sundram, Advocate of EPFO covered various points such as
1) RC Gupta order
2) Cut off date
3) Execising of option
4) Amendment of EPS scheme & inclusion of section 11(4)
5) EPFO implementation order dated 23-3-2017
5) IA of 31-5-2017
6) Acturial valuation report
7) Lastly Pawan Hans order etc..
Justice Lalit questioned & cornered Arayama Sundaram on few occasions & pointed out that Pawan Hans case refers to provident matter( EPF) & not EPS.
EPFO is trying to say that those who have not exercise option & not contributed on actual salary are not covered by SC order of 4-10-2016 because contribution on actual salary not remitted to EPFO
At time Aryama Sundram was trying to confuse court but Justice Lalit passed few remarks.
Any way EPFO advocate will continue arguments pre-lunch session tomorrow also.
Thereafter other pettetioners will get opportunity to put up their arguments.
