22. The State is bound by the fundamental rights of its employees under Articles 14 to 16 of the Constitution of India. It is now well settled that arbitrariness violates the right to equality under Articles 14 to 16 of the Constitution of India.

27. In this case, the Respondent-Writ Petitioner is claiming pension, which is a life long benefit. Denial of pension is a continuing wrong. This Court cannot also be oblivious to the difficulties of a retired employee in approaching the Court, which could include financial constraints.

28. It is settled law that when financial rules framed by the Government such as Pension Rules are capable of more interpretations than one, the Courts should lean towards that interpretation which goes in favour of the employee.

Respected sir,

With reference to the subject cited above we the 72 lakhs Pensioners humble request to you with our natural justification submitted  that d/-25.01.2023 issued circular by the Regional Provident Fund Commissioner-I,(Pension) with the approval of the Central Provident Fund Commissioner, wherein, after referring to the previous circulars d/-4/10/2016 with the approval Sansd and issued circular d/-23/3/2017 also .

The judgment rendered by the Hon’ble Supreme Court dated 04.11.2022 in SLP (C.) Nos. 8658-8659/2019, it has been stated thus .Utmost care should be taken to identify such cases where higher pension was granted on account of judgment of any Court. In such cases, a favourable order shall be obtained from the concerned Court citing the order of Hon’ble Supreme Court dated 04.11.2022 before going ahead with stopping/restoration of pension to wages up to ceiling of Rs. 5,000/- in the initial stages which was introduced by E.P.F.O. and announced by advertisement that eps 95 scheme is better than old pension but now a days no one is stating that better than old pension which was applicable Central Government retired ,even though the new pension scheme is applicable to them.and now they are demanding we want Old Pension ,old pension why  sir ?

माननीया श्रीमती हेमा मालिनी जी सांसद महोदया से भेट.

NAC चीफ माननीय कमांडर अशोक राऊत जी ने EPS 95 पेंशनर्स की शुभचिंतक माननीया श्रीमती हेमा मालिनी जी से भेट कर  उनके प्रति कृतज्ञता व्यक्त की.माननीय डॉ. श्री टी वी सोमानाथन जी केंद्रीय वित्त सचिव के साथ हुई मीटिंग व चर्चा की विस्तार सहित जानकारी दी. साथ ही दिनांक 08.02.2023 को दोपहर में माननीया सुश्री नीलम शमी राव, केंद्रीय प्रोविडेंट फंड कमिश्नर  महोदया के साथ संपन्न होने वाली मीटिंग की भी जानकारी दी.

 *माननीया श्रीमती हेमा मालिनी जी ने दोनों मीटिंगों के विषय में जानकारी प्राप्त करने के बाद समाधान व्यक्त किया व NAC चीफ से कहा कि आप सभी केवल समस्या ही नहीं बता रहे हैं, उसके समाधानों के सुझाव भी दे रहे हैं, यह अच्छी बात है.  मैं पिछले चार वर्षों से आप सभी के कार्य में लगी हुई हैं और अभी भी कोशिश कर रही हूं कि आप सभी वृद्ध पेंशनर्स को जल्दी से जल्दी सम्मानपूर्वक अच्छी पेंशन राशि मिले.

आगे जब श्री राऊत जी ने माननीय श्रीमती हेमा मालिनी जी को बताया कि - *हम NAC के प्रतिनिधि मंडल के साथ माननीय केंद्रीय श्रमसचिव महोदया के साथ मीटिंग करना चाहते थे लेकिन श्रम मंत्रालय से फोन द्वारा बताया गया है कि माननीय केंद्रीय श्रम सचिव महोदया उपलब्ध नहीं हैं इसलिए आपकी मीटिंग CPFC के साथ होना तय हैं".

इस पर माननीय श्रीमती हेमा मालिनी जी ने कहा कि हम आपकी मीटिंग माननीय श्रममत्री जी के साथ करवाते हैं
