 ईपीएफओ की शीर्ष निर्णय लेने वाली संस्था सेंट्रल बोर्ड ऑफ ट्रस्टीज की 229वीं बैठक में लिए गए अहम फैसले।

 केंद्रीय श्रम एवं रोजगार मंत्री श्री भूपेंद्र यादव, उप-अध्यक्ष श्री रामेश्वर तेली, मंत्री  श्रम एवं रोजगार राज्य, सह-उपाध्यक्ष श्री सुनील बर्थवाल, सचिव (श्रम एवं रोजगार) एवं सदस्य सचिव श्री मुखमीत एस. भाटिया, केंद्रीय पीएफ आयुक्त, ईपीएफओ।

 केंद्रीय बोर्ड, ईपीएफ द्वारा निम्नलिखित प्रमुख निर्णय लिए गए: -

 (ए) चार उप-समितियों के गठन के अध्यक्ष के सुझाव, जिसमें कर्मचारियों, नियोक्ता पक्ष के साथ-साथ सरकारी पक्ष के प्रतिनिधियों से बोर्ड के सदस्य शामिल हैं, का बोर्ड द्वारा स्वागत और अनुमोदन किया गया।  स्थापना से संबंधित मामलों और सामाजिक सुरक्षा संहिता के भविष्य के कार्यान्वयन पर दो समितियों की अध्यक्षता श्रम और रोजगार राज्य मंत्री करेंगे।  डिजिटल क्षमता निर्माण और पेंशन संबंधी मुद्दों पर शेष दो समितियों की अध्यक्षता केंद्रीय श्रम और रोजगार सचिव करेंगे।

 (बी) वर्ष 2020-21 के लिए ईपीएफओ के कामकाज पर 68वीं वार्षिक रिपोर्ट के मसौदे को केंद्र सरकार के माध्यम से संसद के समक्ष रखने की सिफारिश के साथ अनुमोदित किया गया था।

 (सी) सी-डैक द्वारा केंद्रीकृत आईटी-सक्षम सिस्टम के विकास के लिए अनुमोदन प्रदान किया गया था।  इसके बाद, क्षेत्रीय कार्यकलाप चरणबद्ध तरीके से एक केंद्रीय डेटाबेस पर चले जाएंगे, जिससे सुचारू संचालन और बेहतर सेवा वितरण संभव हो सकेगा।  केंद्रीकृत प्रणाली किसी भी सदस्य के सभी पीएफ खातों के डी-डुप्लीकेशन और विलय की सुविधा प्रदान करेगी।  यह नौकरी बदलने पर खाते के हस्तांतरण की आवश्यकता को हटा देगा।

 (डी) बोर्ड ने वित्त निवेश और लेखा परीक्षा समिति (एफआईएसी) को मामले-दर-मामला आधार पर निवेश विकल्पों पर निर्णय लेने के लिए सभी ऐसे परिसंपत्ति वर्गों में निवेश के लिए सशक्त बनाने का निर्णय लिया, जो निवेश के पैटर्न में शामिल हैं, जैसा कि अधिसूचित किया गया है।  भारत सरकार।

 बैठक के दौरान, अध्यक्ष, सीबीटी ने 'कोविड को प्रतिक्रिया - 2.0' शीर्षक से एक पुस्तिका का विमोचन किया। यह पुस्तिका कोविड-19 महामारी के कठिन समय के दौरान अपने हितधारकों को नवाचार करने और निर्बाध सेवाएं प्रदान करने के लिए ईपीएफओ की तैयारियों को समाहित करने का एक प्रयास है।  पुस्तिका श्रृंखला में दूसरी है, पहला संस्करण मार्च 2021 में श्रीनगर में आयोजित 228वीं सीबीटी बैठक में जारी किया गया था।

 अध्यक्ष, सीबीटी ने 'निर्बाध: निर्बाध सेवा वितरण' शीर्षक से एक और पुस्तिका जारी की। यह पुस्तिका पिछले तीन वर्षों में 'ईपीएफओ से ई-ईपीएफओ' में सफल डिजिटल परिवर्तन की दिशा में ईपीएफओ द्वारा अपनाई गई पहल और रणनीतियों का संकलन है।  इन प्रयासों ने ईपीएफओ को डिजिटल रूप से कागज रहित संगठन की ओर बढ़ने में सक्षम बनाया है, जिससे इसके सभी हितधारकों के लिए जीवन आसान हो गया है।

 बैठक में नियोक्ता, कर्मचारी और केंद्र सरकार, राज्य सरकार और ईपीएफओ के वरिष्ठ अधिकारी भी मौजूद थे.

Key decisions taken at the 229th meeting of Central Board of Trustees, the apex decision-making body of EPFO.

The 229th meeting of Central Board of Trustees (CBT), apex decision-making body of EPFO, was held today in New Delhi under the chairmanship of Shri Bhupender Yadav, Union Minister for Labour & Employment, Vice-chair Shri Rameswar Teli, Minister of State for Labour & Employment, co-vice chair Shri Sunil Barthwal, Secretary (Labour & Employment) and member secretary Shri Mukhmeet S. Bhatia, Central PF Commissioner, EPFO.

The following key decisions were taken by Central Board, EPF: -

(a) The suggestion of the Chairman to constitute four sub-committees, comprising members of the Board from employees, employers’ side as well as from representatives of the Government side was welcomed and approved by the Board. Two committees on Establishment related matters and futuristic implementation of Social Security Code will be headed by the Minister of State Labour and Employment. The remaining two committees on Digital capacity building and Pension related issues will be headed by Union Labour and Employment Secretary

(b) The draft 68th annual report on the functioning of the EPFO for the year 2020-21 was approved, with the recommendation to place it before the Parliament, through Central Government.

(c) Approval was accorded for development of centralized IT-enabled systems by C-DAC. Post this, the field functionalities will move on a central database in a phased manner enabling smoother operations and enhanced service delivery. The centralized system will facilitate de‐duplication & merger of all PF accounts of any member. It will remove the requirement of transfer of account on change of job.

(d) The Board decided to empower the Finance Investment & Audit Committee (FIAC) to decide upon the investment options, on case-to-case basis, for investment in all such asset classes which are included in the Pattern of Investment as notified by Government of India.

During the meeting, Chairman, CBT released a booklet titled ‘Response to Covid - 2.0.’ The booklet is an effort to encapsulate the preparedness of EPFO to innovate and deliver uninterrupted services to its stakeholders during the difficult time of Covid-19 pandemic. The booklet is the second in the series, first version was released in the 228th CBT meeting held in March 2021 at Srinagar.

Chairman, CBT released another booklet titled ‘Nirbadh: seamless service delivery.’ This booklet is a compilation of initiatives taken and strategies adopted by EPFO towards successful digital transformation from ‘EPFO to e-EPFO’ over the last three years. These efforts have enabled EPFO to move towards digitally interacting paperless organization, thereby enhancing ease of living for all its stakeholders.

In the meeting, representatives from the employers, employees and senior officers of the Central Government, State government and EPFO were also present.

 The framework of social security is an important cornerstone of any modern society. It assures individuals that the society will look after their interest against vagaries of life. The International Labour Organisation (ILO) defines social security as a protection provided to individuals and households by the society to ensure access to health care and to guarantee income security post retirement, unemployment, sickness, invalidity, work injury, maternity or untimely demise.

 As a basic human right defined in UN instruments, it is widely considered as instrumental in a healthy, positive and productive society. In India, the social security legislations derive their strength and spirit from the Directive Principles of the State Policy of the Constitution. Article 41 of the Constitution requires that the State shall, within the limits of its economic capacity and development, make effective provision for securing the right to work, to education and to public assistance in cases of unemployment, old age, sickness and disablement, and in other cases of undeserved want. Furthermore, Article 42 expands the obligations to make provision for securing just and humane conditions of work and for maternity relief.

 Article 47 requires that the State should raise the level of nutrition and the standard of living of its people and improve public health as among its primary duties. These, thus, are the basic frameworks of Social Security provisioning for the citizenry in the country. Social Security in India was traditionally the responsibility of the family/community when the economy was still localised. However, first with gradual industrialisation post-independence, followed by a more rapid globalisation process and liberalised economy after 1991, the bonds within the community weakened and joint families fragmented into nuclear ones. This has necessitated an institutionalized response in the shape of state-cum-society regulated social security arrangement.

Jobs for senior citizens: Centre’s SACRED employment exchange portal opens today, check details

Senior citizens seeking work opportunities can now get a job from the SACRED employment exchange portal.  

Socialbiku : Starting from October 1, senior citizens seeking work opportunities will be able to bag jobs from the Indian government’s first-of-its-kind dedicated employment exchange.  

The portal known as Senior Able Citizens for Re-Employment in Dignity (SACRED) will help Indians above 60 years of age to find jobs easily, right at the comfort of their homes. The portal is operated by the Ministry of Social Justice and Empowerment (MoSJ&E’s) 

In a statement, the ministry said that any job provider - individual, firm, company, partnership, and voluntary organisation - can also register on the portal. “The job provider will specify the task involved and the number of senior citizens that are required to complete it," the ministry said.

The ministry will spend Rs 10 crore to fund the platform development while a maintenance grant of Rs 2 crore has been approved as well. Moreover, additional Rs 10 crore will be spent annually for the publicity of the portal so that more people know about the initiative.

 *Presence of all the important leaders/members of Chikhali Tehsil including Mrs. Shobha Aras ji , National President, Mahila Front, Sau. Sarita Narkhede, Chief Coordinator, Western Zone, Mahila Front, Mr. Rameshwar Shedge, District President, Buldhana, Mr. M. A. Hake.

*The meeting was held under the chairmanship of Shri Nana Garkal, the senior leader and guide of NAC.

*Guests were welcomed.

* Senior leader of Chikhali Tehsil Shri Shivajirao Bansode emphasized on the expansion of the organization, while Tehsil President Shri DR Salokh, Shri Rameshwar Shedge, District President, Buldhana, Shri B.B.Chouhan reiterated the resolve to follow the orders of NAC Chief with full devotion

EPF Pension Case: Supreme Court To Consider If Reference To Larger Bench Is Needed In View Of 'RC Gupta' Decision

The bench said that it was of the prima facie view that EPFO has made out a case.

The Supreme Court on Wednesday decided to consider the issue whether to refer to a larger Bench, the appeals filed by Employees Provident Fund Organization and others including Union of India, challenging the judgments of various High Courts which quashed the Employee's Pension (Amendment) Scheme, 2014. 
A Bench of Justice UU Lalit and Justice Ajay Rastogi observed that it will consider if they are of a prima facie view that the matter needs to be heard by a three-judge Bench and accordingly pass an order by Tuesday, August 24.
The question of referral came up in consideration of submissions made by Senior Advocate C Aryama Sundaram on behalf of the EPFO, with regards to the top Court's judgement in the case of R.C. Gupta and Ors. v Regional Provident Fund Commissioner, Employees' Provident Fund Organisation and Ors, which was delivered by a coordinate bench of 2-judgesbench.

Sundaram made detailed submissions before the Court regarding the RC Gupta judgement as to how it did not consider certain aspects including the necessity of remittance, pension scheme being completely different from the provident fund regime, etc and therefore can only be relied upon to a limited extent in the present case. 
The Bench said, "Our difficulty is that whether there is reasoning or no reasoning, the final conclusion of RC Gupta is that irrespective of whatever time has elapsed, there is no cut off date and it is permissible for somebody to pay arrears for months gone by and have right to switch over to provident fund scheme, to pension fund scheme."

1. You are aware that our case in the Supreme Court is listed tomorrow on 17th August, 2021 as item no. 11. We have engaged Shri Kapil Sibal, Senior Advocate at a fee of Rs. 17.5 lakh per appearance. In addition, he has been charging Rs. 5.5 lakh per conference. So far, he has held five conferences but was kind enough to charge for one only. But now, he is likely to charge for every conference at this rate.

2. NCR/NCAO have already paid for one day fee + conference charges amounting to 23 lakh. In addition, our AOR has also to be paid for each date and briefing for which he is yet to raise the bill. After making payment for one day, we are left with a balance of less than 40 lakh which would not be sufficient for even two days. We are not sure as to how many days, the case will last but our conservative estimate is that it may take 4 to 5 days.

3. All the members have been waiting for this day and have contributed in the past to ensure that we get our legitimate due pension. You will appreciate that we are pitted against the mighty Government/EPFO who is hell bound to ensure that nobody gets his/her legitimate dues and they are doing everything possible on this earth to ensure success of their ill designs.

4. In the above circumstances, our request to all member associations/associate member associations is to pay another instalment of Rs. 100 per member immediately. It should not happen that in the absence of sufficient finances, we lose our case which is otherwise very strong legally. A few associations have not paid the earlier instalment and they are requested to clear the earlier dues as well.

5. We hope that at this time of emergency, everybody will cooperate and send the contribution in the following account immediately. We are aware that the time given is too short but this beyond our control if we want to win our case.

गुजरात राज्य के सभी जिलों के सभी विभागों के अध्यक्ष, मंत्री, सदस्य और सभी पेंशनभोगी भाइयों और बहनों।

मैं उन सभी को सलाम करता हूं जो पिछले पांच साल से पेंशन बढ़ाने के लिए मिलकर काम कर रहे हैं।

विशेष रूप से माननीय राउत साहब के आदेशानुसार अन्य राज्यों में चल रही कार्यवाही के आधार पर समूह के माध्यम से लगातार संदेश भेजे जा रहे हैं।

इस तरह के मैसेज अधिक संख्या में नहीं पहुंचते हैं। जिससे पेंशनर्स की संख्या नहीं बढ़ती। गुजरात में करीब 15 लाख पेंशनभोगी हैं। यह आवश्यक है कि सभी को पेंशन की चल रही कार्यवाही से अवगत कराया जाए।

गुजरात के सभी जिलों के सभी विभागों से एक पोस्टर बैनर अभियान शुरू करने का अनुरोध किया जाता है। नमूना बैनर को ध्यान मे रखकर संघ के अध्यक्ष, विभाग की लड़त समिति और संगठन को एक बैनर बनाना चाहिए और उसमें फोटो के नीचे नाम, गांव, पदनाम विवरण लिखकर एक बैनर तैयार करना चाहिए।

इसे शासन के नियमों का पालन करते हुए जिले के सार्वजनिक स्थान पर स्थापित करने का अनुरोध किया जाता है। जिनके फोटो छोटे-बड़े दैनिक समाचार पत्रों में तथा समाचार चैनलों में समाचार के रूप में विस्तार से देने का अनुरोध है। अन्य राज्यों में बैनर अभियान चलाए जा रहे हैं। जिन्हें ग्रुप में रखा जा रहा है।

श्रम एवं रोजगार मंत्री माननीय श्री भूपेन्द्र यादव साहब दिनांक 21.08.21 को अपने गृहनगर अजमेर आए। फिर ईपीएस 95 पेंशनर्स एसोसिएशन ने व्यक्तिगत रूप से मुलाकात की और पेंशन के संबंध में एक लिखित अभ्यावेदन दिया। उस समय, मंत्री ने कहा कि कार्यवाही जारी थी।

इसके अलावा पेंशन के संबंध में माननीय श्री राउत साहब एवं समिति द्वारा कार्यवाही की जा रही है। झूठी अफवाहों से दूर रहें। संगठित होने के लिए एक साथ काम करने के लिए सभी पेंशनभोगियों के सहयोग की आवश्यकता है। संगठन की ताकत के बिना पेंशन मिलना मुश्किल है।

सुप्रीम कोर्ट ने बुधवार (18 अगस्त) को इस मुद्दे पर विचार करने का फैसला किया कि क्या कर्मचारी भविष्य निधि संगठन और भारत संघ सहित अन्य द्वारा दायर की गई अपीलों को एक बड़ी बेंच को संदर्भित किया जाए, जिसमें विभिन्न उच्च न्यायालयों के फैसले को चुनौती दी गई थी, जिन्होंने कर्मचारी पेंशन (संशोधन) योजना को रद्द कर दिया था। 2014. न्यायमूर्ति यूयू ललित और न्यायमूर्ति अजय रस्तोगी की एक खंडपीठ ने कहा कि यह विचार करेगा कि क्या उनका प्रथम दृष्टया विचार है कि मामले को तीन-न्यायाधीशों की पीठ द्वारा सुना जाना चाहिए और तदनुसार मंगलवार, 24 अगस्त तक एक आदेश पारित करें। ईपीएफओ की ओर से वरिष्ठ अधिवक्ता सी आर्यमा सुंदरम द्वारा आरसी के मामले में शीर्ष न्यायालय के फैसले के संबंध में किए गए प्रस्तुतीकरण पर विचार करने के बाद रेफरल का सवाल आया। गुप्ता व अन्य। क्षेत्रीय भविष्य निधि आयुक्त, कर्मचारी भविष्य निधि संगठन और अन्य, जो 2-न्यायाधीश पीठ की समन्वय पीठ द्वारा दिया गया था।

 

सुंदरम ने आरसी गुप्ता के फैसले के बारे में अदालत के सामने विस्तृत प्रस्तुतियाँ दीं कि कैसे उसने कुछ पहलुओं पर विचार नहीं किया, जिसमें प्रेषण की आवश्यकता, पेंशन योजना भविष्य निधि व्यवस्था से पूरी तरह से अलग है, आदि और इसलिए केवल एक सीमित सीमा तक ही भरोसा किया जा सकता है वर्तमान मामले में।

"हमारी कठिनाई यह है कि तर्क है या नहीं, आरसी गुप्ता का अंतिम निष्कर्ष यह है कि चाहे जो भी समय बीत गया हो, कोई कट ऑफ तारीख नहीं है और किसी के लिए महीनों के लिए बकाया भुगतान करने की अनुमति है और अधिकार है भविष्य निधि योजना, पेंशन निधि योजना में स्विच करने के लिए" बेंच ने कहा।

 

पीठ ने कहा कि वह एक समन्वय पीठ द्वारा निर्धारित एक फैसले की अनदेखी नहीं कर सकती है। आर.सी. में गुप्ता व अन्य। v क्षेत्रीय भविष्य निधि आयुक्त, कर्मचारी भविष्य निधि संगठन और अन्य, जिसे अक्टूबर 2016 में न्यायमूर्ति गोगोई के नेतृत्व वाली पीठ द्वारा तय किया गया था, सुप्रीम कोर्ट ने कर्मचारियों के लिए 1 सितंबर 2014 से छह महीने की ऑप्ट-इन विंडो को रद्द कर दिया था। अनकैप्ड पेंशन योगदान करना जारी रखें। आज, पीठ ने कहा कि वह इस सवाल में नहीं जा सकती कि आरसी गुप्ता सही हैं या नहीं।

EXTRACTS OF THEJUDGMENT....

14. The Bank is a trustee of the account of the pensioners, like the petitioner, and has no authority in the eyes of law to dispute the entitlement of the pension payable to the employees, other than those in the employment of the Bank. To tamper with such account and effect the recovery of pension without any authority, is nothing but a breach of trust of the petitioner by the Bank. We should not be understood to have said that even where there is technical error in calculation, other than of entitlement, is committed resulting in excess payment, the Bank cannot recover it. We have already held that no such case is made out here.

16. Before parting with this Judgment, we need to remind the Bank that the pension payable to the employees upon superannuation is a ‘property’ under Article 300-A of the Constitution of India and it constitutes a fundamental right to livelihood under Article 21 of the Constitution of India. The deprivation, even a part of this amount, cannot be accepted, except in accordance with and authority of law. Article 41 of the Constitution of India in the Part IV of Directive Principles of State Policy has created an obligation upon the State to recognize a right of public assistance in the case of old age, sickness and disablement. Article 46 therein requires the State to promote with special care the economic interests of the weaker sections of the people. In short, the aforesaid provisions of the directive principles of State policy create an obligation upon the State to enact suitable laws, making the provisions to recognize a right of public assistance, to promote economic interests, to protect the life and property of senior citizens, to treat them with respect and dignity and to give wide publicity to it.

17. Unfortunately, the time has come to tell the Bank that the aging is natural process, which leads to weakening of the body and mind. The productivity, working ability and mobility decreases or paralyzes with growing age. The traditional norms, values and culture in the Indian Society demand to treat the senior citizens with respect, dignity and lay stress on providing security, care and assistance to them. It becomes a part of the human right of the senior citizens
