* मा. हेमामालिनी जी ने पेन्शन धारको से साधा सीधा संवाद,जानी पेन्शन धारको की व्यथा,  जगाया EPS 95 पेन्शन धारकों

 के मन में विश्वास. साथ ही दी उनके द्वारा किए गये प्रयत्नों की जानकारी.

 *Under the guidance of Hon. Commander Ashok Raut, National President and under the leadership of Shri Asharam Sharma, National Vice President of the NAC Organization the central team of the organization, met Hema Malini Ji,the well wisher of NAC on 13.1.2021at Vrindawan.

 * Hon.Hema Malini ji directly interacted with the  EPS 95  pensioners, listened to them patientely and encouraged them. 

  Hon Madam also informed our team  about the efforts she is doing  herself for getting our rightful demands  fulfilled.

 *After solid assurances given by Hon.Hema Malini ji, a ray of hope was clearly visible on the faces of the old aged EPS 95 pension holders.

Mr C. A. Sundaram Senior Advocate appeared for central government in Review petition. He cited Pawan Hans judgement of S. C. In the year 2020. Saying retrospective contribution willcreate imbalance. 

SLP no. 8658-59 require closer look. So Review petition revived. 

Next preliminary hearing on 25/2/2021 before appropriate court.

 EPF: Supreme Court withdraws order approving pension in accordance to salary.

New Delhi: The Supreme Court on Friday withdrew its order that upheld the Kerala High Court verdict approving pension in accordance to salary. The decision by the three member bench led by Justice U. U. Lalit comes after a review petition filed by the Employees Provident Fund Organisation (EPFO).

However, the apex court has not stayed the Kerala HC order which approved pension in accordance to salary. The preliminary hearing on appeals filed by the Union Ministry of Labour and Employment and EPFO against the HC order will take place on February 25.

The withdrawal of the SC order will disappoint lakhs of EPF pensioners. But at the same time, the apex court not staying the HC order is a relief.

The HC had pronounced the verdict approving pension in accordance to salary on 12 October 2018. Representing the central government, Attorney General K. K. Venugopal urged the Supreme Court to stay the HC order.

But, Justice Lalit clarified that the HC order cannot be stayed and that the appeals against it will be shifted for preliminary hearing. Otherwise, a notice will have to be issued over the review petition, the bench added.

The HC in its order had removed the Rs 15,000 ceiling to calculate the EPF contribution from employees. This in turn made it possible to avail pension in accordance with the total salary.

On April 1, 2019, the Supreme Court had approved this HC order. Now, the apex court has withdrawn the order issued by former Chief Justice Ranjan Gogoi.

Centre strongly objects pension in accordance to salary

The central government had demanded a stay on the Kerala HC order approving pension in accordance to salary. The Union Ministry of Labour & Employment clarified that pension in accordance to salary was not practical.

The ceiling of Rs 15,000 was fixed targeting the economically and socially backward class. If the ceiling is removed, the EPS will have a shortage of Rs 15,28,519.47 Cr Since the HC order, the EPFO was handed over Rs 839.76 crore. If the appeal from the Ministry of Labour & Employment is approved, recovery of pension will not be possible.

Due to the court verdict, pension increased by up to 50 percent. Such significant increase cannot be recovered during the superannuation of a person, the Centre pointed out.

आज सुप्रीम कोर्ट के अंतरिम आदेश के पश्चात EPS 95 केस की स्थिति इस प्रकार है

आज सुप्रीम कोर्ट के अंतरिम आदेश के पश्चात मेरी पोस्ट के उपरांत मुझे कई मित्रों ने फोन किया और पूछा कि अब केस की क्या स्थिति है।

केस की स्थिति इस प्रकार है।केरला हाई कोर्ट के दिसंबर 2018 के आदेश, जिसके द्बारा ईपीएफओ के 29.08.2014 व 31.05.2017 के आदेशो को निरस्त कर दिया गया था, के खिलाफ एक स्पेशल लीव पिटिशन सुप्रीम कोर्ट में फाइल की गई थी। 

सुप्रीम कोर्ट द्वारा 1 अप्रैल 2019 को इस पिटीशन को खारिज कर दी गया था। ईपीएफओ ने 01.04.2019 के आदेश के खिलाफ एक रिव्यू पिटिशन फाइल की और सुप्रीम कोर्ट से यह प्रार्थना की कि वह अपने आदेश को रिव्यू करें।

 इसके साथ ही साथ भारत सरकार ने एक स्पेशल लीव पिटिशन फाइल की और उसमें कुछ नये मुद्दों को जोडा। नये मुद्दों में ....

1. ईपीएफ पेन्शन फन्ड खत्म हो जाना, यदि पेन्शन वास्तविक सैलरी पर दी जाए,

2. कार्मिक की औसत आयु 83 वर्ष मान कर गणना करना जबकि यूनाइटेड नेशंस द्वारा जारी औसत आयु 70 वर्ष दर्शाई गई है। 

3. Actuarial deficit 15,28,519.47 करोड बताना। 

इन सभी मुद्दो पर सरकार व ईपीएफओ विभिन्न माध्यमो से पूरी तरह से अलग अलग आकन्डे दिए गये हैं जो इस बात का प्रतीक है कि इन सस्थांयो द्बारा दिए गए आकन्डे गुमराह करने वाले हैं। 

इन सभी आकन्डो को खारिज करने के लिए पूर्ण तैयारी है तथा वकीलों को अवगत करा दिया गया है। हमें पूरी आशा है कि होने वाली बहस में सरकार व ईपीएफओ के प्रयासों को विफलता ही मिलेगी। 

अन्त में आप सभी को अवगत कराना है कि हजारों पेन्शनरस द्वारा सुप्रीम कोर्ट में ईपीएफओ  के आदेशो को निरस्त करने की विभिन्न याचिकाओ की सुनवाई भी इन के साथ ही होगी। 

मित्रों हमें धैर्य रखना है और यह ध्यान रखना है  कि उम्मीद पर ही दुनिया कायम है।

There was a Proposal to move retirement data by 62 Years . However Government didn't take any decision on it till .Let's understand the impact of this decision .

Already Our students are waiting for  new Opportunity and if Government take such decision it will be delayed for new opportunity. The retirement age of colonels other than that of the Army Medical Corps and Military Nursing Service will be increased to 57 years from the current 54. 

The retirement age of brigadiers is proposed to be increased to 58 years from the current 56 years and that of the major generals to 59 from the current 58. 

No change has been proposed for the lieutenant general rank, which will continue to be 60 years. 

Such decision is not possible to take in one night by government. It is now totally   under government ,Whether they are taking such decision or not .

 Hon MP Navneet Rana told the delegation that I am fully aware of this subject.  This is a burning and sensitive question related to 65 lakh pension holders and their family members, of which about 30 thousand pension holders are from my Amravati region.  I am committed for  justice to these pension holders.

  These pension holders get only Rs.200 to Rs.3000 pension even after deducting money in pension fund under government rules during their service.  This amount is very less to live a respectable life where as Rs 4 lakh 37 thousand crore is available in the pension fund.

 These pension holders should be provided medical facilities under the Bharat Ayushman Scheme along with a respectable pension.

  The issue was also effectively raised earlier in the last session of the Lok Sabha by the Hon.Navneet Rana, MP.

 It should be known that under the leadership of Commander Ashok Raut, National President of the organization,Chain fast Agitation is going on at the headquarters of the organization, Buldhana, for the last 757 days.

EPS 95 पेंशन धारकों के कल्याण के लिए संघर्षरत राष्ट्रव्यापी संगठन, राष्ट्रीय संघर्ष समिति (NAC) के राष्ट्रीय अध्यक्ष मा. कमांडर अशोक राऊत के मार्गदर्शन में संघटन के राष्ट्रीय महासचिव वीरेन्द्र सिंह, राष्ट्रीय मुख्य न्यायिक सलाहकार श्री कविश डांगे.

राष्ट्रीय मुख्य सलाहकार श्री पी. एन. पाटिल,प्रांतीय सचिव, महाराष्ट्र श्री अशोक टेंभरे व श्री सुभाष थोरात ने मा. श्रीमती नवनीत रवि राणा जी से  मुलाकात की, ज्ञापन दिया व पेंशन धारकों को सम्मानपूर्ण पेंशन मिले इस विषय पर चर्चा की

इस पर मा. नवनीत राणा जी की ओर से प्रतिनिधि मंडल को बताया कि उन्हें इस विषय की पूरी जानकारी है. देश के 65 लाख पेन्शन धारकों व उनके  परिवार जनों से जुडा यह एक ज्वलंत व संवेदन शील  प्रश्न है जिसमें से लगभग 30 हजार पेंशन धारक मेरे अमरावती क्षेत्र के है.

इन पेंशन धारकों को न्याय दिलाने हेतु मैं वचनबद्ध हूं

 इन पेंशन धारकों  ने अपनी सेवाकाल में सरकार के नियमों के आधीन पेंशन फंड में पैसा कटवाने के बाद भी केवल रु.200 से लेकर 3000 तक की ही पेंशन मिलती  है. यह राशि सम्मानपूर्ण जीवन जीवन जीने के लिए बहुत ही कम है. जब कि पेंशन फंड में 4 लाख 37 हजार करोड़ रु उपलब्ध है.

इन पैंशन धारकों को सम्मानपूर्ण पेंशन के साथ ही भारत आयुष्मान योजना अन्तर्गत मेडिकल सुविधा प्रदान की जाए

ज्ञातव्य हो कि इस मुद्दे को मा. सांसद महोदया द्वारा लोकसभा के पिछले सत्र में पहले भी प्रभावशाली ढंग से उठाया गया था.

ज्ञातव्य हो कि संगठन के राष्ट्रीय अध्यक्ष कमांडर अशोक राऊत के नेतृत्व  में संगठन के मुख्यालय बुलढाणा में पिछले 757 दिनों से क्रमिक अनशन जारी है
