RPFC Chandigarh not given benefit of 12 month. I had written to CPFC New Delhi Labour Secretary govt of India Labour department PM of India through uncounted emails but all in vain.

RPFC Chandigarh have no record of 2002 and I department locked out on 30.6.2002.RPFC Chandigarh written to my department and who had provide record should not acceptable to RPFC Chandigarh

The Employee's Pension Scheme 95 has completed 25 years on 16 November 2020  I have tried to evaluate it's performance during the period of 25 years by giving facts and figures from various Reports .

PERFORMANCE EVALUATION AND ANALYSIS 

Pension scheme was drafted by EPFO with the help of Actuary's.That too  could not  be introduced for about two and half months as various Labour Unions and organizations demanded the pension as third benefit without diverting any contribution from Provident Fund of the member's ultimately when 4 month's were left to the next General parliamentary Election  in 1996 the Government Of India took a bold step ignoring all hurdles promulgating an ordinance on 16/11/1995 amending the EPF & MP Act 1952 facilitating  the Government Of India to introduce the Employee's Pension Scheme 1995 with effect from 16/11/1995 All the assets and liabilities of the old scheme were transferred and undertook by the Employee's Pension fund.

श्री आर सी पटेल डेयरी निगम और श्री जसुभाई बारोट हस्तशिल्प निगम के प्रतिनिधियों ने आमने-सामने मुलाकात की और आवेदन पत्र सौंपा।  मा।  प्रधानमंत्री श्री मोदी साहेब को आमने-सामने देने का अनुरोध करते हुए, श्री चावड़ा साहब ने देने का आश्वासन दिया है।  इसके लिए श्री चावड़ा को बहुत-बहुत धन्यवाद।

 Except the petitioners of RC Gupta case, No other pensioner whether from Exempted or Un-exempted and Pre or Post 1.9.2014 retiree should remain eligible for higher pension

EPFO now knows it very well that the directives/pleadings of Pension Division regarding differentiating between  Exempted & Un-Exempted and Pre or post 1.9.2014 retirees as per their letters dt. 31 5.2017 and probably 21.6.2017 respectively may not be accepted by the Courts and we have also seen the results in various High Courts.

In May 2019, the Legal Division came in forefront and issued a synopsis on 24.5.2019 (after the meeting of all field officers of ZOs/ROs held at Delhi on 18.5.2019) for defending the cases in Courts.  Now, they have issued detailed directives dt. 16.9.2020 by totally highjacking the matter from Pension Division wherein they have now also asked ZOs & ROs to review even the settled cases.

Their strategy in my personal view is to divert the issue by taking a new stand now with which they are expecting that except the petitioners of RC Gupta case, no other pensioner whether from Exempted or Un-exempted and Pre or Post 1.9.2014 retiree should remain eligible for higher pension.

The new pleadings (24.5.2019 & 16.9 2020) by the Legal Division are that a "retired employee" cannot submit joint option under Para 11(3) of EPS'95 as they can do so only during their service tenure (as per Legal Div.).

While thinking so, they are forgetting the decision on this issue already announced by the Kerala High Court & confirmed (12.7.2016) by the Supreme Court in Austin Joseph Case wherein all the petitioners were retirees The above fact has also been communucated to EPFO HQ/ Legal Division by the EPFO Trivendrum in c/w the directive dt. 16.9.2020 itself..

They are also forgetting that a Conscious decision has already been taken by EPFO & MoL&E to grant this benefit of pension revIsion on higher wages to the Superannuated cases too at all levels and now they can't retract from the same now.  Even a Div. Bench of Pb & Hr. High Court on 9.7.2019 had said so (reg. Eligibility of retirees & all other pleadings in a 65 page affidavit  dt.6.7.2019) and finally EPFO had revised the pension of petitiobers in seven writ petitions and informed the Court.

Even the deteriorating  financial position of EPFO may not help them as the pensioners are seeking higher pension as per EPS'95  Scheme only.

That is why, I thought it proper to appraise all concerned officers of MoL&E, ALL CBT Members, EPFO HQ, all ZOs and all ROs besides my pensioner friends/advocates regarding the factual position as per office record so that the latest directive dt. 16.9.2020 may be QUESTIONED BY EVERYONE

So, pl read and make your advocates read the contents of that complaint document dt. 7 12.2020 in the common interest of all pensioners.

 नमस्कार मित्रो

पेंशन में बढ़ोतरी न होने की वजह पिछली सरकारों की लापरवाही ही है।

1995में बने कानून के अनुसार हर दो वर्ष में रिवाइज होना था लेकिन आज तक नहीं हुआ।

हमारी पेंशन के लिए कम्पनी मालिक 8,33% सिर्फ 15000₹की पेमेटं का ही जमा करते हैं उससे ऊपर की पेमेटं का नहीं। जबकि रिटायरमेटं के समय हमें 30000,50000₹तक पेमेटं मिली,इसी आधार पर पेंशन मिलना चाहिए, ऐसा केरल हाई कोर्ट व सुपिमकोर्ट ने पहले ही फैसला दे दिया लेकिन ईपीओ ने सुप्रीम कोर्ट में पिटीसन दायर करके फैसला रुकवा दिया है।

सरकारी कर्मचारियो को उनके रिटायरमेटं के समय पर मिलने वाली पेमेटं के आधार पर पेंशन मिलती है इसलिए उनकी पेंशन अधिक।

ईपीओ का कहना है कि पेंशन देने के लिए पैसा कम्पनी मालिक जमा करे या सरकार दे,कम्पनी मालिक तो देने से रहे क्योंकि कयी कम्पनियों के मालिक बदल गए हैं अब सरकार को ही इसके लिए पैसे का इंतजाम करना होगा, सरकार पर दबाव सासंद व विधायकों को ही बनाना चाहिए क्योंकि समस्या गम्भीर है।

हेमा मालिनी जी व कुछ और लोगों ने मोदी जी से बात की है ,कोई परिणाम नहीं मिला।

सरकार को एक कानून और बनाना चाहिए कि जब कोई भी नौकरी के लिए जाता है सरकारी हो या प्रायवेट उसकी पेमेटं का 10%उसके माता-पिता के ज्वाइंट एकाउंट में जमा होगें।लोग करोड़ों कमाते हैं लेकिन माता-पिता को देने में तकलीफ होती है।

 आदरणीय कोहली जी इपीएस 95 के पेंशनर्स के लिए पिछले चार साल से अपने अथक प्रयास से अपने सूचना के अधिकार के ज्ञान द्वारा सहयोग कर रहे हैं वह अतुलनीय है..... लेकिन अभी आई उनकी पोस्ट कि ईपीएफओ 23.3.2017 के आदेश को वापस लेने के लिए तरीका खोज रहा है.....

मैं उनके सामने तो इस प्रकार के विषय में अल्पज्ञानी हूँ लेकिन जो कुछ भी जानकारी हे उसके अनुसार यह बताना चाहता हूं कि यह असंभव है...कोई भी सरकारी विभाग चार साल पहले निकाले गए अपने ही उस आदेश को वापस नहीं ले सकता जिसे 25000 से अधिक पेंशनर्स पर लागू कर चुका है..... 

उक्त आदेश को वापस लेने का अर्थ उन सभी 25000 पेंशनर्स को दी गई बढ़ी हुई पेंशन को वापस रिकवरी करने की प्रक्रिया भी शुरू करना जिनमें अति वयोवृद्ध ओर बेसहारा भी हो सकते हैं जिनके पास कुछ भी नहीं बचा हो... उनसे कैसे वसुली करेंगे  .... ओर कई पेंशनर्स कानूनी विशेषज्ञ भी हो सकते हैं (जिनमें वह खुद भी है) जो अदालतों में जा सकते हैं... ओर फिर से एक अलग विषय पर लंबी थका देने वाली कानूनी लड़ाई...

हाँ इससे यह जरूर हो सकता है कि सरकार/ईपीएफओ मूल विषय को कुछ हद तक भटकाने में सफल हो जाए लेकिन क्या सुप्रीम कोर्ट ऐसा होने देगा... क्या वरियता के आधार पर पुरानी याचिकाओं पर फैसला नहीं देगा.... क्या अभी तक बीसियों हाइकोर्ट के फैसलों को वह नकार देगा... 

मैरे खयाल से यह मामले को लटकाने के प्रयास से ज्यादा कुछ नहीं है.... यहाँ यह भी देखना होगा कि देश का कानून... जिसमें लिमिटेड एक्ट 1963 भी किसी भी है जिसमें किसी भी प्रक्रिया के लिए समय सीमा निर्धारित की गई है वह क्या कहता है.....

 अत:में आदरणीय प्रवीण कोहली सर सहित सभी प्रबुद्ध जनों ओर हमारे NCR ओर अन्य याचिकाकर्ताओं के पदाधिकारियों से निवेदन करुंगा की इस विषय पर विचार करें ओर हमारी याचिका 1134/2018 सहित अन्य याचिकाओं पर तुरंत सुनवाई पर प्रयास करें... जिससे लाखों पेंशनर्स को राहत के साथ रोज नित नई बातों से छुटकारा मिल सके! धन्यवाद🙏

Respected EPS 95 pension holders, brothers and sisters,

As we all know that thousands of agitations were successfully carried out by all of you bravehearts from Tehsil level to the National level, Delhi in the last 4 years to get the demands of EPS 95 pension holders sanctioned.

On the appeal of the Hon. Labor Minister, all the agitations have been withdrawn by the NAC. Only the chain fast at NAC Headquarters, Buldhana (Maharashtra) has started uninterrupted since last 715 days.

On date 4.3.2020 Hon Hema Malini ji, Member of Parliament, Mathura, accompanied our delegation In a meeting with the Hon Prime Minister .

The Hon Prime Minister assured us that all our demands would be fulfilled. He even gave directions to the the concerned Minister. Now, the eyes of 65 lakh old pension holders eyes are on The Hon. Prime Minister. Thereof, We sincerely hope that our main demands will be fulfilled soon.

The Government is likely to approve our demands till or before the upcoming budget session.

Several agencies have their roles in this tedious process, including the Parliamentary Committee on Labor.

We are aware that our pensioner siblings are leaving us and this world day by day. *Therefore, the "Nationwide Contact Campaign" has been started at the national level* by our NAC to get our demands approved at the earliest.

दिनांक 4.3.2020 को मा. हेमा मालिनी जी, संसद सदस्य मथुरा की अगुवाई में मा. प्रधानमंत्री जी के साथ NAC प्रतिनिधियों के साथ हुई मीटिंग में मा. प्रधानमंत्री जी द्वारा आश्वासन व संबंधित मा. मंत्री महोदय जी को दिशा निर्देश देने के बाद से ही 65 लाख वृद्ध पेंशन धारकों की निगाहें मा. प्रधानमंत्री पर टिकी हुई हैं कि हमारी मुख्य मांगे अब शीघ्र ही पूरी होगी.

आनेवाले बजट सत्र तक या उसके पहले हमारी मांगों को सरकार द्वारा मंजूर किए जाने की संभावना दिखाई दे रही है.

इस प्रक्रिया में पार्लियामेंट्री कमेटी ऑन लेबर सहित कई घटकों की अपनी अपनी भूमिकाएं हैं.

हमें विदित ही है कि हमारे पेंशन धारक भाई बहन दिन प्रतिदिन हमें छोड़कर संसार से बिदा हो रहे हैं इसलिए NAC द्वारा हमारी मांगों को शीघ्रातिशीघ्र मंजूर करवाने हेतु,
