 Respected sir ,

       I , on behalf of all EPS 1995  pensioners welcome your goodself with best wishes to have taken up the present position .

     As we all know and anticipate ,sir , that there shall be an equality of justice to the citizens in terms of their service in democratic governance that needs to be ensured all time  by the hon'ble govt of the day under the values of the Indian constitution .

      In brief it is brought to your kind knowledge that a grave injustice has been done to the workmen of organised sector in their retirement benefit of service  pension without dearance allowance as it is not provided in the employees pension scheme 1995 , which is ought not to have been , but has been imposed with it's defeciancies and continued without revisions perpetuating it for decades (25 years) together  with a quite  indifferent pattern amidst the scenario of the present systems of pension applicable to central or state govts .  

     The pensioners under the EPS 1995  continue to get a negligible meagre  pension without dearance allowance  for their service in the range of less than Rs 1000 at minimum and about Rs 3000 at maximum .

  Dissatisfied with the system of pension under the EPS 1995 , the petitions have come up before the supreme court and all of them tagged together against the review petition /SLP case filed by the EPFO and the hon'ble govt of India respectively is scheduled to be posted for probable final hearing on 16th October 2020 .

   It is our sincere appeal to your kindself that the stand to be taken by the EPFO , the hon'ble ministry of labour & employment , govt of India in the said cases may kindly have to be scientific , logic and above all humanistic approach without dogmatism  on the following main issues among others . 

  1 ) Enhancement of minimum pension to the  EPS 1995 pensioners ( DIRE NEED ) regardless of their position in higher pension on actual wages that makes negligible difference and remains in the present range  with the definition factor of EPS 95 pensionable service

 (Non- beneficiaries of higher pension on actual ages ) as per the recommendation report of parliamentary committee 147 with it's present valuation to a level as being demanded by the pensioners on the basis of present minimum cost of living across the country that comes not less than Rs 10000 .

2) Grant of dearance allowance , an essential component , a requisite part of service pension that links with inflation to serve it's purpose ,  as being followed in case of govt servants .

 3) Revision of pension of all EPS 1995  pensioners of exempted and unexempted companies  by refixation of higher pension on actual wages / fifty percent of last drawn 12 months average  wages being the universal formula . 

 Sir , it is very humble request of all the EPS 95 pensioners particularly ,  being the voice of poor category that are in majority,  suffering untold hardships and dependancy with the present meagre pension to the hon'ble govt demanding justice in order that they live a life of human dignity with socio -economic security with a liveable pension that happens only when they are provided the pension by it's enhancement of minimum with dearance allowance  that suits the present cost of living /revision on actual wages subject to further revisions warranting time to time .

एक विचित्र प्रकार की समस्या पिछले कई दिनों से निरंतर सुनने में आ रही है कि जिन पेंशनरों की कतिथ unexempted संस्थाएं पूर्णतः बंद हो चुकी हैं,उनके पेंशनर्स को भी सर्वोच्च न्यायालय के निर्णय का लाभ EPFO द्वारा नहीं दिया जा रहा है,कारण सिर्फ इतना है,कि पेंशन का हिसाब किताब पेंशनरों को अपने संस्था से ला कर देना होगा।

विवाद तो EPFO का exempted संस्थानों के पेंशनरों के साथ रहा है,और वो विवाद सर्वोच्च न्यायालय में चल भी रहा है,इसका unexempted वालों से कुछ भी लेना देना नहीं है।

अब बंद हो चुकी unexempted संस्थानों की मैनेजमेंट का कोई आता पता ही नहीं है तो पेंशनर्स बेचारे उन्हें कहाँ से ढूंढ कर लाये और EPFO की शर्तों को पूरा करें तो करें कैसे ?

यहाँ ये तथ्य निर्विवादित है कि unexempted संस्थाओं के सेवानिवृत्त या ऐसी बंद हो चुकी संस्थानों के कर्मचारियों के वेतन से की गई पेंशन फण्ड और भविष्य निधि अंशदान की कटौती का हिसाब किताब सीधे सीधे EPFO के अधीन ही रहता है,सारे विवरण EPFO के रिकॉर्ड में दर्ज होते आये हैं,ऐसे में उनके दावे जो माननीय सर्वोच्च न्यायालय के आदेश दिनाँक 4/10/2016 के अनुपालन में कोई विवाद नहीं है,उक्त आदेश EPFO द्वारा मान्य भी है,तो फिर प्रशासनिक खानापूर्ति के नाम पर इस विशेष वर्ग के पेंशनरों को विधि मान्य हक से वंचित रखना न्यायसंगत प्रतीत नहीं होता।

दुर्भाग्य की बात है कि इस बात को लेकर कोई भी सामूहिक प्रयास ऐसे पेंशनरों की ओर से न्यायालय का दरवाजा खटखटाया गया है न ही EPFO के समक्ष किसी भी संगठन द्वारा कोई चर्चा किये जाने की कोई जानकारी सामने नहीं आई है।इनका मामला न तो न्यूनतम पेंशन में इजाफा करने का है,न ही हायर पेंशन प्रदान करने का।इनका तो सिर्फ अंशदान के आधार पर निर्धारित कर देय पेंशन के भुगतान का मामला है,जिसे न्यायालय से लेकर सरकार,EPFO तक पहले से मान्य कर चुकी है।

इस मामले को मुझे लगता है कि NAC, राष्ट्रीय संघर्ष समिति ही वो मंच है जो समस्या का निराकरण कर सकती है।अतः आग्रह है कि इस मुद्दे को भी NAC अपने एजेंडा में शामिल कर श्रम मंत्री जी से EPFO को समुचित निर्देश दिलाने की पहल करें जिससे अनेक उपेक्षित पेंशनर्स को उनका हक दिलाया जा सके।

दि 09 ।09। 2020 ची सभा श्रम मंत्रालयाने सी बी टी  प्रतिनिधी बरोबर चर्चे करिता बोलवीली आहे , हे आपले दुर्दैव की देशातील राष्ट्रीय कामगार संघटना आपल्या विषया च्या बाबतीत अगदी दुजा भाव ठेवत आहे .(आपण त्याचा स्पष्ट संदर्भ दिला आहे )

प्रश्न हा आहे की या सभेत ह्या पत्राची दाखल घेतल्या जाईल काय ???

आपण आपल्या घटनात्मक अधिकाराची मागणी योग्य पटला समोर करीत आहो काय ? ? ? 

असे ऐकिवात आहे की ही सभा eps 95 च्या कायद्या मध्ये दुरुस्ती करिता आयोजित आहे .

आणि हे जर खरे असेल तर epfo व श्रम मंत्रालय सर्वोच्च न्यायालयाच्या निर्णयाला पुनर्विचार याचीकेचा आग्रह का करिते .

तरीसुद्धा लोकशाही मध्ये  आपले विचारात अभिव्यक्त करायचा आपला घटनात्मक हक्क आपण वापरतो आहो व  कोविड 19 च्या  परिस्थितीत आपल्या जवळ जास्त पर्याय नाही हे ही सत्य आहे .

सर्व सामन्यांच्या माहिती साठीच का नसे समिती आपले प्रयत्न अव्यहात ठेवत आहे हे पण कमी नव्हे .

NAC के प्रमुख कमांडर अशोक राऊत ने दिनांक 30.9.2020 मा. श्रममंत्री महोदय श्री संतोषकुमार गंगवार जी से EPS  95 पेन्शन धारकों  की मांगो के सदर्भ में फोन पर बातचीत की व  मंत्री महोदय से पेन्शन धारकों की मांगो को विना विलंब मंजूर करने हेतु निवेदन किया.

* 👉बातचीत के बाद इसी संदर्भ में NAC चीफ द्वारा मा. श्रममंत्री जी को एक पत्र लिखा गया है व पत्र की प्रतीलीपी मा. प्रधानमंत्री जी, मा. वित्तमंत्री जी, मा. राज्य मंत्री , प्रधानमंत्री कार्यालय, मा. श्रीमती हेमा मालिनी जी, संसद सदस्य, मथुरा सभी सन्माननीय CBT सदस्य व मा. सी पी एफ सी को भेजी गई.

* 👉पत्र में मा. प्रधानमंत्री के साथ हुई बैठक, मा. श्रीमती हेमा मालिनी जी द्वारा लिखे गये दो पत्र व NAC के पत्र दिनांक 13.5.2020 का संदर्भ दिया गया है.

👉पत्र में EPS 95 पेन्शन धारकों की परिस्थिति का उल्लेख करते हुये लिखा गया है कि वृद्धावस्था, कम पेन्शन व किसी भी प्रकार की मेडिकल सुविधा न होने के कारण पेन्शन धारक संसार से बिदा होते जा रहे हैं.

Dear Brothers & Sisters,

A Big Question, hunts us all Retirees, CAN WE make a change or achieve!. Our humble opinion is: let us be optimistic and take all challenges with positive mind. If we do this, it's our half victory.

We are united or fragmented, take it just as mind set, not to be boggled at, but surmounted. We are first Retiree or Pensioner as one race. We have very common identity, cause & purpose to achieve.

Think about it, how to make ourselves as reckoning force. It's necessary. We have done a lot ground work, created awareness among ourselves and now we see people coming forward to support us vehemently. Now, we need to think beyond this and move forward. New Delhi is epicenter of political power of Nation. Let us make New Delhi as our Action Center.

Now we need to finalize the ISSUES on which we have to work and focus:

1. Pension Revision as in RBI:

It's all time strategy to link our Pension related issues with RBI Pension Scheme. It's boon for us, we need not to deviate from it. Pension Agreement dated 29.10.1993 is a legal document which connects all terms including revision to RBI Pension Rules & Regulations. Cl.12 of Agreement is speaking one.

2. No discrimination in DA Scheme, whether neutralization, percentage or periodicity. One industry-wide one compensation Policy, as held by highest court of the land. D.A. is a compensation of price rise. If it is 100% neutralization on quarterly average for working people, it can't be under 100% and six monthly average for retirees.

3. Health Insurance from Welfare Funds as envisaged vide DFS letter dated 24.2.2012. Banks must comply with Govt directive. There must be equal right to Retirees in WFs spending.

4. Proper implementation of SCI judgement in 1616/1684 case & Payment of difference of pension & commutation arrears along with 9% interest, as awarded in judgement.

5. Inclusion of Special Allowance for superannuation benefits like Pension, Gratuity etc. from 1.11.2012.

On these vital issues of common interest of Pensioners, some centralized and united mass action has been necessary to focus our issues, but due to Covid 19, to obtain necessary permission has been a difficult task. However, Sri R. S. Sharma, has been able to obtain permission to sit on Dharana. He is Secretary, AIBRWA & Patron of Mission Kuber- New Delhi.

We appeal all New Delhi based Pensioners/ Activists, whether in some Groups or Unions or lone to rise above all their considerations & affiliations to join & support Dharana on both days to make it grand success. Respected sir , 

  With all great respect to your kindself , i submit my grieviences related to my basic livilihood maintenance cost  with the pension of EPS 1995 seeking justice from the hon'ble supreme court .

     Having served the company/ board / corporation / public sector unit  ----------- -------------------for --------    years  ,   I get the pension of Rs.-------- only . And Iam facing the untold  hardships with dependancy on others in my advanced age  in the present cost of living with medical expenses of old age illnesses . 

The hon'ble govt of India with untenable reasons  is not yet inclined and not ready to enhance the minimum pension to a  reasonable level with D A as being sought  by all pensioners that comes not less than Rs 10000 being average cost of living across the nation , although it can do with it's discretionary powers with the articles of Indian constitution for maintenance of life of senior citizens .  

Majority of these pensioners are poor who need immediate relief  of enhancement of minimum pension to Rs 9000 with dearance allowance so as to meet the present cost of livilihood .

    Therefore it is my request to your good self that while hearing the cases of review petition and SLP petition filed by EPFO and the hon'ble govt of India respectively against EPS 95 pension cases tagged together , the issue of hike of minimum pension , mainly concerned to majority of EPS 95 pensioners , may kindly be taken into consideration for justice along with the cases of eligiblity of pensioners of  exempted companies /corporations  and higher pension on actual wages .

   IN ViEW  OF  OUR ADVANCED AGE FACTOR , WORSENED CONDITIONS  OF  LIVILIHOOD IN DESPAIR , AND  DEPENDANCY AND  INDIGNITY  OF  HUMAN LIFE ,THE HONBLE  SUPREME COURT MAY KINDLY RENDER THE  JUSTICE  with the directions to the hon'ble central govt for our welfare in order that WE HAVE A LIVEABLE PENSION OF MINIMUM  STANDARD  WITH  DEARANCE ALLOWANCE  , IN  CONSISTENT  WITH  RIGHT  TO LIVE  UNDER ARTICLE  21 OF THE INDIAN CONSTITUTION .
