 Meeting of Our EPS 95  pensioners was Organized EPS95 NAC Pensioners Guntur District 

Yesterday a meeting of our pensioners was organized and I have

participated in the retired employees meeting of APSRTC presided over by Sri.Daniel, Vinukonda Venkateswarlu at Bapatla yesterday afternoon alongwith our EPS95 NAC Pensioners Guntur District Org. Secretaries S/sri.PVK Ramarao, RTC and K.Shankararao of APCO. 

Sri.A.Harinarayana of APCO and others participated please. Greeted the pensioners on the occasion of pensioners day and distributed pamphlets besides informing the latest position on our demands please.👍🙏..

Today's NAC WB meeting  at Rajpur Club Maidan.

After one year in COVID situation it was our 1st meeting. We received 40 new members including renewal.  Near about 50 participants were present. My sincere thanks & regards to all participants of today's meeting. 

Thanks to Shri Kasinath Ghosh Coordinator of South Kolkata and his team for well arrangements. Apprised the present status of NAC activities & it's demands. It was moral boosting gathering. All were very enthusiastic & ready for taking part in our future direct action agitation programme. Wishing them good health.

देश के बुजुर्गों ने कभी ऐसा सोचा न होगा कि ऐसे दिन भी देखने पड़ेंगे कि उनकी ही चुनी हुई जनता की सरकार उनसे सड़कों में लेट लेट कर अपनी जायज मांगो को मनवाने की लिये अपने अपने घरों से हजारों मील दूर दिल्ली जा कर लंगड़ाते,घसीटे,कमजोर कदमों के साथ देश के ,

प्रधानमंत्री जी से सिर्फ 10 मिनट देने और उनकी गुहार सुनाने के लिए इतना सब कुछ करना पड़ सकता है।तीन साल से भी ज्यादा वक्त गुजर गया लेकिन धन्य है कि दुनियाँ के सबसे बड़े प्रजातंत्र कहे जाने वाले इस देश के मुखिया के पास अपने जिंदगी से हारे,निर्बल,निःसहाय बुजुर्गों की तकलीफों को सुनने के लिए 10 मिनेट का भी वक़्त नही।

जनप्रतिनिधि ,जनता के सेवक,ये सारे शब्द निरर्थक से हो गए हैं।एक तरफ दमड़ी दमड़ी जोड़ कर न्यायालाओं में वर्षों से संघर्ष जारी रखे हुए है,तो दूसरी ओर कमजोर शरीर के साथ सड़कों में संघर्ष करने को मजबूर हैं।

कोई सरकार इतनी असंवेदनशील कैसे हो सकती है,जो सबके साथ सबके विकास की बात कहते नहीं थकती।हमें तो लगता है कि शीघ्र ही यदि मांगो पर कोई सकारात्मक हल नहीं निकाला जाता है तो लोगों को भी अपनी सोच में बदलाव लाना ही होगा...लेकिन किस तरह ?

शायद मित्रों के पास इसका कोई जबाव हो

Dear EPS 95 pensioners,

I am happy to inform you all that Mr Murali Krishna state organising secretary  of AP-NAC has organised meetings in 4 different places during the last 10 days and created awareness among our pensioners about the  NAC activities and also demands were placed before the Honorable Prime Minister and   explained in detail.

Meetings were conducted at Vijayawada, Tenali Guntur and singarayakonda of Andhra Pradesh.

Later he has developed the idea of printing phamplets  on behalf of district committee  of NAC about the  recent developments, of  NAC.

These phamplets were printed by three districts committees and were distributed among the pensioners who do not process the smartphones. The pensioners felt very happy  on reading this pamphlet which is printed in  local language Telugu and expressed their gratitude for taking up our issues to the level of Honorable Prime Minister and planning to achieve much better financial benefit to one and all.

Apart from this activity,  Mr Murali Krishna has taken up tours by his scooter to Delhi, and South India and other regions of the country, on which our demands were sticked, thereby creating awareness among the citizens of India.

I appreciate the efforts of brother Mr Murali Krishna. The strain taken  is praise worthy and commendable.

Pensioners 1 : I am EPF pension and drawing 1421/- per month after deposit 40601/- for higher pension.

RPFC Chandigarh not given benefit of 12 month. I had written to CPFC New Delhi Labour Secretary govt of India Labour department PM of India through uncounted emails but all in vain.

RPFC Chandigarh have no record of 2002 and I department locked out on 30.6.2002.RPFC Chandigarh written to my department and who had provide record should not acceptable to RPFC Chandigarh

It is shameful for Labour department Govt of India.

The Employee's Pension Scheme 95 has completed 25 years on 16 November 2020  I have tried to evaluate it's performance during the period of 25 years by giving facts and figures from various Reports .

PERFORMANCE EVALUATION AND ANALYSIS 

Pension scheme was drafted by EPFO with the help of Actuary's.That too  could not  be introduced for about two and half months as various Labour Unions and organizations demanded the pension as third benefit without diverting any contribution from Provident Fund of the member's ultimately when 4 month's were left to the next General parliamentary Election  in 1996 the Government Of India took a bold step ignoring all hurdles promulgating an ordinance on 16/11/1995 amending the EPF & MP Act 1952 facilitating  the Government Of India to introduce the Employee's Pension Scheme 1995 with effect from 16/11/1995 All the assets and liabilities of the old scheme were transferred and undertook by the Employee's Pension fund.

 Except the petitioners of RC Gupta case, No other pensioner whether from Exempted or Un-exempted and Pre or Post 1.9.2014 retiree should remain eligible for higher pension

EPFO now knows it very well that the directives/pleadings of Pension Division regarding differentiating between  Exempted & Un-Exempted and Pre or post 1.9.2014 retirees as per their letters dt. 31 5.2017 and probably 21.6.2017 respectively may not be accepted by the Courts and we have also seen the results in various High Courts.

In May 2019, the Legal Division came in forefront and issued a synopsis on 24.5.2019 (after the meeting of all field officers of ZOs/ROs held at Delhi on 18.5.2019) for defending the cases in Courts.  Now, they have issued detailed directives dt. 16.9.2020 by totally highjacking the matter from Pension Division wherein they have now also asked ZOs & ROs to review even the settled cases.

Their strategy in my personal view is to divert the issue by taking a new stand now with which they are expecting that except the petitioners of RC Gupta case, no other pensioner whether from Exempted or Un-exempted and Pre or Post 1.9.2014 retiree should remain eligible for higher pension.

The new pleadings (24.5.2019 & 16.9 2020) by the Legal Division are that a "retired employee" cannot submit joint option under Para 11(3) of EPS'95 as they can do so only during their service tenure (as per Legal Div.).

While thinking so, they are forgetting the decision on this issue already announced by the Kerala High Court & confirmed (12.7.2016) by the Supreme Court in Austin Joseph Case wherein all the petitioners were retirees The above fact has also been communucated to EPFO HQ/ Legal Division by the EPFO Trivendrum in c/w the directive dt. 16.9.2020 itself..

They are also forgetting that a Conscious decision has already been taken by EPFO & MoL&E to grant this benefit of pension revIsion on higher wages to the Superannuated cases too at all levels and now they can't retract from the same now.  Even a Div. Bench of Pb & Hr. High Court on 9.7.2019 had said so (reg. Eligibility of retirees & all other pleadings in a 65 page affidavit  dt.6.7.2019) and finally EPFO had revised the pension of petitiobers in seven writ petitions and informed the Court.

Even the deteriorating  financial position of EPFO may not help them as the pensioners are seeking higher pension as per EPS'95  Scheme only.

That is why, I thought it proper to appraise all concerned officers of MoL&E, ALL CBT Members, EPFO HQ, all ZOs and all ROs besides my pensioner friends/advocates regarding the factual position as per office record so that the latest directive dt. 16.9.2020 may be QUESTIONED BY EVERYONE

So, pl read and make your advocates read the contents of that complaint document dt. 7 12.2020 in the common interest of all pensioners.
