 GOVERNMENT OF INDIA MINISTRY OF LABOUR AND EMPLOYMENT RAJYA SABHA UNSTARRED QUESTION NO. 2659 TO BE ANSWERED ON 11.08.2021 CONTRIBUTION TOWARDS EPS 2659. 

SMT. AMBIKA SONI: Will the Minister of Labour and Employment be pleased to state: (a)whether it is a fact that Government has not given its Employees' Pesnion Scheme (EPS) contribution to Employees Provident Fund Organisation (EPFO) during the last five years; (b)if so, the reasons therefor along with the quantum of pending arrears in this regard ason date; and (c)the corrective steps taken by Government in this regard? 

ANSWER MINISTER OF STATE FOR LABOUR AND EMPLOYMENT (SHRI RAMESWAR TELI) 

(a) & (b): The details of funds released to the Employees’ Provident Fund Organisation (EPFO) during the last five years towards Government of India’s statutory contribution of 1.16 per cent under the Employees’ Pension Scheme (EPS), 1995 are as follows: Year Funds released (Rupees in Crore) 2016-17 3,525.00 2017-18 4,040.18 2018-19 3,900.00 2019-20 3696.67 2020-21 6027.61 As on 31.03.2021, there is a cumulative arrear of Rs.10,589.20 crore (provisional). (c): Keeping in view the trend, a provision of Rs. 6364 crore has been made in Budget Estimates 2021-22 towards Government of India’s statutory contribution under EPS, 1995.

Please note that:

1. Additional Liability of Govt of India if all active members (beyond 1.9.2014) & retirees (prior to 1.9.2014) opt for higher pension: NIL as GOI has to contribute @1.16% only on the amount of Ceiling wages (upper cap) which is already being done.  This has also been clarified in the office note granting approval (issued by MoL&E on 16.3.2017) for implementing RC Gupta Judgment (4.10.2016) & related court matters that “THERE IS NO FINANCIAL IMPLICATION ON THE PART OF GOI, AS GOI’s CONTRIBUTION OF 1.16% OF WAGES UNDER EPS 1995 IS RESTRICTED TO THE WAGE CEILING.” So, the SLP filed by UOI is not justified.


2. EPFO has projected liability of Rs 15 Lakh Crore based on Actuary Reports (year 2017) considering 19,33,91,860 members whereas as per Affidavit dt 28.01.2021 filed by Mr. Jagmohan, ACC (Legal), EPFO in SLP(C) no. 8658-8659 of 2019 in SC, the members drawing more than Rs. 15000 were only 1,03,40,378 as on 3/2019 and 1,26,57,556 as on 3/2020 BUT AS PER THE CLAIM BEFORE THE SC, THE LIABILITY OF 19,33,91,860 MEMBERS HAS BEEN PROJECTED to be Rs 15 Lakh Crores by EPFO

,संगठन में वह शक्ति है कि कठिन से कठिन समस्या का समाधान भी संभव है बशर्ते पूरी ईमानदारी, निष्ठा व लगन से परिश्रम कर लक्ष्य तक पहुँचने की कोशिश की जाए और राष्ट्रीय संघर्ष समिति की समस्त इकाइयों का यदि इसी तरह सहयोग प्राप्त होता रहेगा तो अतिशीघ्र ई पी एस-95 पेंशनरों की प्रस्तावित सभी मांगें पूरी हो जायेंगीं! राष्ट्रीय संघर्ष समिति के अथक प्रयासों का ही परिणाम है कि पुनः मथुरा सांसद मा० श्रीमती हेमामालिनी जी के सहयोग से उनके साथ ही राष्ट्रीय नेतृत्व के शीर्ष प्रमुख पदाधिकारियों को विगत 05 अगस्त 2021 को मा० प्रधान मंत्री जी से मुलाकात कर पुनः एकबार ई पी एस-95 पेंशनरों की मांगों पर से चर्चा कर सभी मांगें शीघ्र ही पूरा किये जाने का अनुरोध करने अवसर भी प्राप्त हो सका! इस अभूतपूर्व सहयोग के लिए मा० सांसद महोदया श्रीमती हेमा मालिनी जी बहुत - बहुत बधाई की पात्र हैं साथ ही महाराष्ट्र की मा० सांसद महोदया श्रीमतीलाई नवनीत राणा जी भी हम ई पी एस-95 पेंशनरों की मांगों को बार- बार  लोकसभा में प्रभाव शाली तरीके से रखते हुए मांगें शीघ्र पूरा करने का अनुरोध मा० सभापति जी के माध्यम से मा० प्रधान मंत्री जी से करने के लिए बधाई की पात्र हैं।

आज दिनांक 3 अगस्त, 2021 को NAC के राष्ट्रीय मुख्य न्यायिक सलाहकार ॲड. श्री कविश जी डांगे क्रमिक अनशन कर्ताओं को मिलने बुलडाणा आये थे.  उनका स्वागत बुलडाणा टीम द्वारा किया गया. उनके साथ आये खामगाव तहसील के अध्यक्ष इंजी.सुभाष थोरात, NAC नेता तथा बिजली बोर्ड के  सेवानिवृत्त कार्यकारी अभियंता इंजी. अंबादास जी जाधव, व इंजी. ए डब्ल्यू सोनवणे जी का स्वागत किया गया. मा. श्री डांगे जी ने अनशन कर्ताओं का मार्गदर्शन किया व उत्साह बढाया.


Today on August 3, 2021, National Chief Legal Adviser of NAC Adv. Shri Kavish ji Dange had visited  Buldana to meet the NAC's Agitators participating in Chain hunger fasting. He was welcomed by the Buldana team.  He was accompanied by Er.. Subhash Ji Thorat, President of Khamgaon Tehsil, NAC leader and retired Executive Engineer of Electricity Board, Er.  Ambadas Ji Jadhav and Er.  AW Sonawane ji were also welcomed. 
   Hon. Shri Dange ji guided the Agitators  and encouraged them.
