Dear Friends,

1. You are aware that our case in the Supreme Court is listed tomorrow on 17th August, 2021 as item no. 11. We have engaged Shri Kapil Sibal, Senior Advocate at a fee of Rs. 17.5 lakh per appearance. In addition, he has been charging Rs. 5.5 lakh per conference. So far, he has held five conferences but was kind enough to charge for one only. But now, he is likely to charge for every conference at this rate.

2. NCR/NCAO have already paid for one day fee + conference charges amounting to 23 lakh. In addition, our AOR has also to be paid for each date and briefing for which he is yet to raise the bill. After making payment for one day, we are left with a balance of less than 40 lakh which would not be sufficient for even two days. We are not sure as to how many days, the case will last but our conservative estimate is that it may take 4 to 5 days.

3. All the members have been waiting for this day and have contributed in the past to ensure that we get our legitimate due pension. You will appreciate that we are pitted against the mighty Government/EPFO who is hell bound to ensure that nobody gets his/her legitimate dues and they are doing everything possible on this earth to ensure success of their ill designs.

4. In the above circumstances, our request to all member associations/associate member associations is to pay another instalment of Rs. 100 per member immediately. It should not happen that in the absence of sufficient finances, we lose our case which is otherwise very strong legally. A few associations have not paid the earlier instalment and they are requested to clear the earlier dues as well.

5. We hope that at this time of emergency, everybody will cooperate and send the contribution in the following account immediately. We are aware that the time given is too short but this beyond our control if we want to win our case.

गुजरात राज्य के सभी जिलों के सभी विभागों के अध्यक्ष, मंत्री, सदस्य और सभी पेंशनभोगी भाइयों और बहनों।

मैं उन सभी को सलाम करता हूं जो पिछले पांच साल से पेंशन बढ़ाने के लिए मिलकर काम कर रहे हैं।

विशेष रूप से माननीय राउत साहब के आदेशानुसार अन्य राज्यों में चल रही कार्यवाही के आधार पर समूह के माध्यम से लगातार संदेश भेजे जा रहे हैं।

इस तरह के मैसेज अधिक संख्या में नहीं पहुंचते हैं। जिससे पेंशनर्स की संख्या नहीं बढ़ती। गुजरात में करीब 15 लाख पेंशनभोगी हैं। यह आवश्यक है कि सभी को पेंशन की चल रही कार्यवाही से अवगत कराया जाए।

गुजरात के सभी जिलों के सभी विभागों से एक पोस्टर बैनर अभियान शुरू करने का अनुरोध किया जाता है। नमूना बैनर को ध्यान मे रखकर संघ के अध्यक्ष, विभाग की लड़त समिति और संगठन को एक बैनर बनाना चाहिए और उसमें फोटो के नीचे नाम, गांव, पदनाम विवरण लिखकर एक बैनर तैयार करना चाहिए।

इसे शासन के नियमों का पालन करते हुए जिले के सार्वजनिक स्थान पर स्थापित करने का अनुरोध किया जाता है। जिनके फोटो छोटे-बड़े दैनिक समाचार पत्रों में तथा समाचार चैनलों में समाचार के रूप में विस्तार से देने का अनुरोध है। अन्य राज्यों में बैनर अभियान चलाए जा रहे हैं। जिन्हें ग्रुप में रखा जा रहा है।

श्रम एवं रोजगार मंत्री माननीय श्री भूपेन्द्र यादव साहब दिनांक 21.08.21 को अपने गृहनगर अजमेर आए। फिर ईपीएस 95 पेंशनर्स एसोसिएशन ने व्यक्तिगत रूप से मुलाकात की और पेंशन के संबंध में एक लिखित अभ्यावेदन दिया। उस समय, मंत्री ने कहा कि कार्यवाही जारी थी।

इसके अलावा पेंशन के संबंध में माननीय श्री राउत साहब एवं समिति द्वारा कार्यवाही की जा रही है। झूठी अफवाहों से दूर रहें। संगठित होने के लिए एक साथ काम करने के लिए सभी पेंशनभोगियों के सहयोग की आवश्यकता है। संगठन की ताकत के बिना पेंशन मिलना मुश्किल है।

Dear Sir(s),

I am sorry to inform you that due to oversight in one of the important files of MoL&E (Reply dated 09.05.2017 of my RTI application no. 50237 dt 14.02.2017), while sharing some extracted pages of correspondence by highlighting relevant text regarding No Liability of MoL&E & Eligibility of Retirees , it has been found today that some of the pages were missing and some were duplicate in the shared file. Inadvertent mistakes on my part due to heavy single handed work load are deeply regretted.

After extracting the relevant documents from the complete file, I am re-sharing only the important documents in order to prove that:

(a) There is no financial liability on MoL&E/GOI by allowing revision of pension on higher wages after getting the differential amount deposited along with up to date interest w.e.f. 16.11.1995 till the date of its deposit

(b) The benefit of pension revision is also be extended to Superannuated cases

(c) The financial liability in implementing the Hon’ble Supreme Court order will be met out from the Pension Fund as undertaken by EPFO while submitting its proposal to MoL&E on 10.01.2017 while seeking approval to implement the decisions of Apex Court and subsequent recommendations of Pension & EDLI Implementation Committee (PEIC) in its 38th Meeting held on 08.12.2016 & approval accorded by the Central Board of Trustees (CBT) of EPFO in its 215th Meeting held on 19.12.2016.

Kindly ignore the earlier 18 page Pdf file having file name “NO LIABILITY OF GOI & RETIREES ARE ELIGIBLE – MoL&E CORRESPONDENCE” and please consider the UPDATED file being shared now which contains 23 pages (wherein some the not so important pages have been removed).

Copy of GSR 134 dt 28.02.1996 has been forwarded today to all the Senior Advocates, AORs and some Advocates who are defending Pensioners in the Apex Court. Text of the letter is being shared for the information of my pensioner friends.

Dear Sir(s),

Namaskar!!

Large numbers of requests have been received by me during the last few days from many Advocates & Pensioners for providing them a copy of GSR 134 dt 28.02.1996, if available, as they could not find the same anywhere. The same had been provided there & then.

Initially, I too failed to find the same despite my best efforts by searching from the websites of various concerned public authorities including EPFO HQ & MoL&E.  Then I followed the RTI route and finally MoL&E provided me with a copy vide its letter dt 05.10.2017 in reply to my RTI application no. MLABE/R/2017/51246 dt 24.09.2017 wherein they also stated that “the notification was not readily traceable, therefore the same was brought from Central Secretariat Library”.  

Since this GSR 134 dt. 28.02.1996 will be one of the main bones of contention before the 3-Judge Bench in the Hon'ble Apex Court, I am sharing the same for your ready reference.  Through this GSR, following proviso had been added to Para 11(3) of EPS 1995 Scheme which says that:

“if at the option of the employer and employee, contribution paid on salary exceeding Rs. 5,000 per month from the date of commencement of this Scheme or from the date salary exceeds Rs. 5000 whichever is later and 8.33 per cent share of employers thereof is remitted into Pension Fund, pensionable salary shall be based on such higher salary” 

If you require any other document relating to EPS pension matter, please just send a message and the document, if available, will be immediately shared.  I have procured large number of relevant documents from MoL&E as well as EPFO (Head Office and all Zonal/ Regional Offices of EPFO across India) through RTI mode in reply to my RTI applications (around 4000) in the last more than 4 years and have been sharing such procured authentic documents amongst pensioners/ serving employees/ advocates etc from time to time as my FREE SEWA.

सुप्रीम कोर्ट ने बुधवार (18 अगस्त) को इस मुद्दे पर विचार करने का फैसला किया कि क्या कर्मचारी भविष्य निधि संगठन और भारत संघ सहित अन्य द्वारा दायर की गई अपीलों को एक बड़ी बेंच को संदर्भित किया जाए, जिसमें विभिन्न उच्च न्यायालयों के फैसले को चुनौती दी गई थी, जिन्होंने कर्मचारी पेंशन (संशोधन) योजना को रद्द कर दिया था। 2014. न्यायमूर्ति यूयू ललित और न्यायमूर्ति अजय रस्तोगी की एक खंडपीठ ने कहा कि यह विचार करेगा कि क्या उनका प्रथम दृष्टया विचार है कि मामले को तीन-न्यायाधीशों की पीठ द्वारा सुना जाना चाहिए और तदनुसार मंगलवार, 24 अगस्त तक एक आदेश पारित करें। ईपीएफओ की ओर से वरिष्ठ अधिवक्ता सी आर्यमा सुंदरम द्वारा आरसी के मामले में शीर्ष न्यायालय के फैसले के संबंध में किए गए प्रस्तुतीकरण पर विचार करने के बाद रेफरल का सवाल आया। गुप्ता व अन्य। क्षेत्रीय भविष्य निधि आयुक्त, कर्मचारी भविष्य निधि संगठन और अन्य, जो 2-न्यायाधीश पीठ की समन्वय पीठ द्वारा दिया गया था।

 

सुंदरम ने आरसी गुप्ता के फैसले के बारे में अदालत के सामने विस्तृत प्रस्तुतियाँ दीं कि कैसे उसने कुछ पहलुओं पर विचार नहीं किया, जिसमें प्रेषण की आवश्यकता, पेंशन योजना भविष्य निधि व्यवस्था से पूरी तरह से अलग है, आदि और इसलिए केवल एक सीमित सीमा तक ही भरोसा किया जा सकता है वर्तमान मामले में।

"हमारी कठिनाई यह है कि तर्क है या नहीं, आरसी गुप्ता का अंतिम निष्कर्ष यह है कि चाहे जो भी समय बीत गया हो, कोई कट ऑफ तारीख नहीं है और किसी के लिए महीनों के लिए बकाया भुगतान करने की अनुमति है और अधिकार है भविष्य निधि योजना, पेंशन निधि योजना में स्विच करने के लिए" बेंच ने कहा।

 

पीठ ने कहा कि वह एक समन्वय पीठ द्वारा निर्धारित एक फैसले की अनदेखी नहीं कर सकती है। आर.सी. में गुप्ता व अन्य। v क्षेत्रीय भविष्य निधि आयुक्त, कर्मचारी भविष्य निधि संगठन और अन्य, जिसे अक्टूबर 2016 में न्यायमूर्ति गोगोई के नेतृत्व वाली पीठ द्वारा तय किया गया था, सुप्रीम कोर्ट ने कर्मचारियों के लिए 1 सितंबर 2014 से छह महीने की ऑप्ट-इन विंडो को रद्द कर दिया था। अनकैप्ड पेंशन योगदान करना जारी रखें। आज, पीठ ने कहा कि वह इस सवाल में नहीं जा सकती कि आरसी गुप्ता सही हैं या नहीं।

Justice Lalit questioned & cornered  Arayama Sundaram on few occasions & pointed out that Pawan Hans case refers to provident matter( EPF) & not EPS. 

EPFO is trying to say that those who have not exercise option & not contributed on actual salary are not covered by SC order of  4-10-2016 because contribution on actual salary not remitted to EPFO 

At time Aryama Sundram was trying to confuse court but Justice Lalit passed few remarks.

Any way EPFO advocate will continue arguments pre-lunch session tomorrow also. 

Thereafter other pettetioners will get opportunity to put up their arguments.

सुप्रीम कोर्ट का फैसला

 सभी पेंशनभोगियों की जानकारी के लिए

 प्रिय मित्रों,

 यह आश्चर्य की बात है कि 01 07 2015 को भारत के सर्वोच्च न्यायालय द्वारा दिया गया एक ऐतिहासिक निर्णय, सिविल अपील संख्या।  2015 का 1123 किसी का ध्यान नहीं गया और श्री एस आर सेन गुप्ता से आईबीए को एक संक्षिप्त पत्र को छोड़कर, किसी अन्य संघ ने कोई कदम नहीं उठाया है।  फैसले की मुख्य विशेषताएं:

 1. बेंच ने आधिकारिक तौर पर फैसला सुनाया है कि पेंशन एक अधिकार है और इसका भुगतान सरकार के विवेक पर निर्भर नहीं करता है।  पेंशन नियमों द्वारा शासित होती है और उन नियमों के भीतर आने वाला सरकारी कर्मचारी पेंशन का दावा करने का हकदार होता है।

 2. निर्णय ने माना है कि पेंशन का संशोधन और वेतनमान का संशोधन अविभाज्य है।

 3. पीठ ने दोहराया है कि संशोधन पर मूल पेंशन पूर्व-संशोधित वेतनमान के अनुरूप संशोधित वेतनमान में न्यूनतम वेतन बैंड में मूल पेंशन के 50% से कम नहीं हो सकती है।

 4. सरकार पेंशनभोगियों के वैध बकाया से इनकार करने के लिए वित्तीय बोझ की दलील नहीं ले सकती है।

 5. सरकार को अनुचित मुकदमेबाजी से बचना चाहिए और मुकदमेबाजी के लिए किसी मुकदमेबाजी को प्रोत्साहित नहीं करना चाहिए।

 6. जब पेंशन को एक अधिकार माना जाता है न कि इनाम के रूप में, इस अनुमान के परिणाम के रूप में कि पेंशन का संशोधन और वेतनमान में संशोधन अविभाज्य है, पेंशन का उन्नयन भी एक अधिकार है और इनाम नहीं है।

 निर्णय डी एस नाकारा मामले पर निर्णय पर आधारित है।

 निर्णय बहुत स्पष्ट है और मुझे आश्चर्य है कि कैसे किसी ने महत्वपूर्ण पहलुओं पर ध्यान नहीं दिया और किसी ने इस मामले को सरकार के साथ क्यों नहीं उठाया।

 फैसले पर किसी ने प्रतिक्रिया क्यों नहीं दी यह आश्चर्यजनक और हैरान करने वाला है।

 प्रिय पेंशनभोगियों!

 इस संदेश को अपनी संपर्क सूची में कम से कम बीस लोगों (गैर-पेंशनभोगी भी भारत के नागरिक के रूप में) को अग्रेषित करें;  और बदले में उनमें से प्रत्येक को ऐसा ही करने के लिए कहें।

लखीमपुर खीरी,13अगस्त 2021,राष्ट्रीय संघर्ष समिति के मंडलीय एवम् जिला इकाई के पदाधिकारियों की बैठक राष्ट्रीय संघर्ष समिति के मंडलीय समन्वयक श्री शमशुल हसन सिद्दीकी के महराज नगर स्थिति कैंप कार्यालय/आवास पर श्री सत्य प्रकाश अवस्थी  संयोजक की अध्यकछता में सम्पन्न हुई।इस बैठक में राष्ट्रीय संघर्ष समिति के अध्कछ श्री पूतान लाल,एवम् सचिव श्री सूर्य प्रकाश मिश्रा द्वारा इपीएस95 पेंशनर्स की पेंशन वृद्धि में ईपीएफओ द्वारा अड़ंगा लगाने,एवम् माननीय सुप्रीम कोर्ट द्वारा  प्रकरण की सुनवाई न कर तारीख पर तारीख़  बढ़ाने पर खेद वयक्त करते हुए रोष वेयाक्त करते हुए किसियारी समिति की सिफारिशों के अनुरूप रुपया7500/+डी. ए. के साथ चिकित्सा सुविधा अनुमन्य करने की मांग की गई।

   बैठक में मंडलीय समन्वयक श्री शमशुल हसन सिद्दीकी द्वारा केंद्र सरकार एवम् ईपीएफओ की पेंशन वृद्धि की राह में अधांगेबाजी की नीति की भर्त्सना की गई एवम् यह भी कहा गया के यदि केंद्र सरकार,प्रधानमंत्री जी एवम् सर्वोच्च न्यायालय द्वारा सकारात्मक रवैया अपनाते हुए इपीएस95की पेंशन वृद्धि नहीं की जाती है तो स्थिति विस्फोटक हो सकती है।सभा के अंत में सभी पदाधिकारियों द्वारा ।जय घोष करते हुए अपनी 7500 के साथ डी. ए. एवम् चिकित्सा सुविधा की मांग का ज़ोर दार ढंग से समर्थन किया गया।इस बैठक में जिला एवम् मंडल के पदाधिकारी उपस्थित रहे,एवम् मंडलीय समन्वयक श्री सिद्दीकी द्वारा सभी आगंतुकों का आभार व्यक्त किया गया
